They made an existing one enforceable — with the same force as any physical hazard regulation, and with personal officer liability attached under Section 27. § 01 — The Obligation

The regulator no longer asks whether your people are stressed. It asks what you documented before they were.

Under the WHS Regulations as amended in 2023, a person conducting a business or undertaking must identify psychosocial hazards, assess the risks they create, and implement control measures — in that order, and in writing. The Managing Psychosocial Hazards at Work Code of Practice sets out what a compliant process looks like, and it is the standard an inspector applies when a complaint, an incident, or a workers compensation claim brings your organisation into view.

Section 27 places the due diligence duty on officers personally — the Principal, the Director, the Board Chair, the CEO. The question in an investigation is not whether the organisation cared about its people. It is whether the officer can produce the survey, the risk assessment, the control documentation, and the review cycle. Intent is not evidence. Documentation is.

§ 02 — The Hazard Categories

Ten hazards. Every workplace carries several.

Psychosocial hazards are defined, categorised, and regulated. The survey exists to establish which ones your workplace actually carries — and at what severity — before the regulator establishes it for you.
